By accessing and using the services of Ericks Webs Design (“we,” “us,” or “our”), you agree to comply with and be bound by the following terms and conditions.
1. Services Provided
We offer web design, development, SEO, hosting, and related services. The scope and deliverables of each project are outlined in individual agreements, proposals, or invoices.
2. Website Maintenance & Support Plan
- Subscription: Services under this plan are billed monthly. By paying your first maintenance invoice, you authorize recurring monthly billing.
- Cancellation: You may cancel the Website Maintenance & Support Plan at any time with 30 days’ written notice. Upon cancellation, hosting services will terminate at the end of the final paid period.
- Third-Party Software: We maintain themes (Divi) and plugins. If a third-party developer discontinues a tool or an update causes site-wide incompatibility, labor for a custom fix or replacement is not included in the flat monthly rate and will be quoted separately.
3. Client Responsibilities & Site Edits
- Onboarding: You agree to provide accurate information, content, and approvals in a timely manner to avoid delays.
- Medical Data/HIPAA: We can configure privacy-conscious integrations and coordinate with approved vendors, but we do not provide legal or regulatory compliance certification. The Client remains responsible for obtaining appropriate compliance guidance and for its use and handling of patient data.
- Client Edits: If you or a third party make changes to the website code, design, or plugins that result in errors or “breaking” the site, Ericks Webs Design is not responsible for fixing these issues for free. Repairing client-inflicted errors will be billed at our standard hourly rate.
4. Support, Maintenance & Availability
- Business Hours: Our standard operating hours are Monday – Friday, 9:00 AM – 5:00 PM CST.
- Response Times: We strive to respond to all support requests within 24–48 business hours.
- Maintenance Priority: Clients on the Website Maintenance & Support Plan receive priority support via our client portal.
- Emergency Support: Support required outside of business hours for “emergency” fixes (not caused by server outages) may be subject to an After-Hours Emergency Fee.
5. Payments & Suspension of Services
- Late Payments: Invoices remaining unpaid 5 days past the due date are considered in default.
- Suspension of Work: We reserve the right to immediately pause all active work if an account has an overdue balance.
- Hosting Suspension: For accounts more than 30 days overdue, we reserve the right to suspend web hosting services, which will result in the website becoming inaccessible.
- Admin Access: Full “Administrator” access to the CMS is granted only once the initial project balance is paid in full.
6. Intellectual Property
All custom work created by Ericks Webs Design remains our intellectual property until full payment is received. Upon full payment, ownership of the final website design is transferred to the client. We reserve the right to display completed work in our portfolio.
7. Strict No Refund Policy
- Non-Refundable: All deposits, installment payments, and monthly maintenance fees are strictly non-refundable.
- Labor & Time: Fees paid for time already spent on research, design, or development are not refundable under any circumstances.
8. Warranties & Disclaimers
Our services are provided “as is.” While we aim for 99.9% uptime, we make no guarantees regarding search engine rankings, specific traffic increases, or compatibility with all future browser updates. We are not liable for any loss of revenue or appointments due to temporary downtime.
9. Limitation of Liability
Ericks Webs Design shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, revenue, or business, regardless of the cause.
10. Governing Law
These terms are governed by the laws of the State of Texas.

Secure Encrypted Data Transmission
Advertising, Analytics, and Third-Party Accounts
When advertising or analytics services are included, the client authorizes us to configure and manage approved platforms, tags, data connections, audiences, and conversion measurement within the agreed scope. Advertising spend, platform fees, and third-party charges are separate unless a written agreement says otherwise. The client remains responsible for account ownership, billing methods, legal claims, offer accuracy, required industry disclosures, and final approval of advertising content.
Advertising platforms, search engines, and social networks control their own review, auction, delivery, attribution, and policy systems. We do not guarantee rankings, impressions, clicks, lead volume, cost per lead, sales, or revenue. We may pause or decline work that appears unlawful, misleading, unsafe, or inconsistent with platform rules.
Data, Privacy, and Measurement
Our website and service workflows may use analytics, CRM, automation, and advertising measurement as described in our Privacy Policy. Clients are responsible for providing any privacy notices, consents, opt-out mechanisms, and agreements required for their own websites, customers, industries, and jurisdictions. Unless specifically agreed in writing, public forms must not be used to transmit protected health information, government identifiers, financial credentials, passwords, or other highly sensitive data.
