Terms and Conditions

Welcome to Ericks Webs Design (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website and the services we provide. By accessing or using our site or services, you agree to be bound by these Terms.

1. Services

We offer professional web design, development, SEO, hosting, and related digital services. Service details, deliverables, and pricing will be outlined in your proposal, invoice, or signed agreement.

2. Client Responsibilities

• You agree to provide all necessary content, feedback, and approvals in a timely manner.
• You are responsible for ensuring that all materials provided to us are legally owned or properly licensed.
• Client Edits: If you or a third party make changes to the website code, design, or plugins that result in errors or “breaking” the site, Ericks Webs Design is not responsible for fixing these issues for free. Repairing client-inflicted errors will be billed at our standard hourly rate.

3. Support, Maintenance & Availability

To ensure high-quality service, we operate under specific support guidelines:

• Business Hours: Our standard operating hours are Monday – Friday, 9:00 AM – 5:00 PM CST. We observe all major US holidays.
• Response Times: We strive to respond to all support requests within 24–48 business hours. Requests received after 5:00 PM on Friday will be processed the following Monday. We do not offer 24/7 on-call support unless explicitly stated in a custom Enterprise Agreement.
• Maintenance Plans: Clients on our monthly Maintenance Plan receive priority support. Clients without a plan are supported on a first-come, first-served basis.
• Emergency Support: Support required outside of business hours or for immediate “emergency” fixes (not caused by server outages) may be subject to an After-Hours Emergency Fee.

4. Payments & Suspension of Services

• Payment Schedule: Payment terms will be specified in your service agreement. Invoices are due upon receipt unless a specific due date is listed.
• Late Payments: Invoices remaining unpaid 5 days past the due date are considered in default.
• Suspension of Work: We reserve the right to immediately pause all active work, consultations, and support if an account has an overdue balance.
• Admin Access: Full “Administrator” access to your website CMS (WordPress) is only granted once the project balance is paid in full. Until then, the Company retains administrative control to protect the asset.
• Hosting Suspension: For accounts more than 30 days overdue, we reserve the right to suspend web hosting services, which may result in your website becoming inaccessible to the public.

5. Intellectual Property

All content, code, designs, and materials developed by us remain the property of Ericks Webs Design until full payment is received. Once paid in full, a non-exclusive, non-transferable license is granted for use of the final deliverables.

6. Strict No Refund Policy

Due to the custom nature of digital design and development work:

• Non-Refundable: All deposits and installment payments are strictly non-refundable once paid.
• Labor & Time: Fees paid for time already spent on research, design, development, or meetings are not refundable under any circumstances.
• Cancellations: You may cancel services at any time via written notice. Upon cancellation, you remain responsible for paying for all work completed up to the point of cancellation.

7. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, revenue, or business arising from your use of our services.

8. Changes to Services or Terms

We reserve the right to update our services or these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles.
